Does the ADA prohibit retaliation?

Yes. The ADA does indeed protect against retaliation. Even if you don’t have a disability that qualifies under the ADA, if you are retaliated against for investigating or pursuing your rights under the ADA you may have a claim under the ADA. Similarly, even if you are not the one with the disability but you aide or participate in a proceeding, investigation or litigation regarding someone else in the company that might have an ADA claim and you are subsequently retaliated against because of your participation, you likely have a claim.
If you have been discriminated or retaliated against by an employer -- or prospective employer -- because of your impairment, click here to have an attorney from Feldman Fox & Morgado review the basic facts of your case. We will not charge you for this review.
